Having regard to the issue involved in this writ application, namely, allowing the petitioner to appear before the Review Medical Board, learned counsel for the respondents having received instruction has taken a stand that the case of the petitioner shall be considered by the Review Medical Board. That being so, the grievance of the petitioner to the extent of allowing the petitioner to appear before the Review Medical Board stands redressed.

This application is, accordingly, disposed of with a direction to the respondents to consider the case of the petitioner

Patna High Court CWJC No.6206 of 2015 (3) dt.08-05-2015 by way of examining the physical fitness of the petitioner by a Review Medical Board.

It goes without saying that not only the Review Medical Board shall consider the case of the petitioner strictly in accordance with the prescribed standards but also in accordance with law within a period of four months from the date of receipt of this order.
