JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-09-2017 The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 143 of 2017, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 35 litres of country made wine along with 150 litres of mahua pass.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and moreover, he has sufficiently been punished for the said offence as he has been in judicial custody since 05.06.2017 and so far one other criminal antecedent is concerned that is not of the similar nature and he is on bail in that case.
Heard learned A.P.P. also.

No.41070 of 2017 (3) dt.14-09-2017 Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner remained in custody for more than three months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Jagdishpur P.S. Case No. 143 of 2017.
It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
