2.The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Mahakar P.S. Case No. 66 of 2024 instituted for the offence under Sections 147, 148, 149, 341, 342, 323, 307, 302, 504, 506 and 120(B) of the Indian Penal Code and Section 3/4 of Prevention of Dian Witch Act.
3. The case of the prosecution is that the petitioner along with 11 others being armed with tangi, pasuli, khanti, iron rod and lathi arrived at the door of the informant. They entered in the house of the informant. They pulled his father Jagdish Manjhi out of the house and started assaulting him. It is further alleged that Barhan Manjhi, Rohit Manjhi, Madan Manjhi, Jatan
Patna High Court CR. MISC. No.15284 of 2025(2) dt.05-03-2025 2/3 Manjhi, Manoj Manjhi and Mithilesh Manjhi closed the father of the informant in Anganwari Kendra and while being rushed to hospital, he died.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is a lady and she has falsely been implicated in this case. A statement has been made in para3 of this petition that the petitioner has got no criminal antecedent. The nature of allegation is general and omnibus. There is no specific allegation against the petitioner. It has also been submitted that co-accused persons having similar nature of allegation have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 29.01.2025 in Cr. Misc. No. 67299 of 2024.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Mahakar P.S. Case No. 66 of 2024, she will
