JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-04-2019 Learned counsel for the petitioner submits that he is only looking for a direction to the Principal Secretary, Road Construct Department, Government of Bihar (respondent no. 2) to consider and dispose of his pending appeal against the black listing order dated 02.04.2018 passed by the Engineer-in-Chief, Road Construction Department, Government of Bihar, Patna (respondent no.3).

It is stated that the appeal is pending before the Principal Secretary of the Department since 09.04.2018. It is submitted that the order of black listing got a civil consequence as because of that the petitioner cannot participate in future

Learned counsel for the State is present.

In the given facts of the case, this writ application is disposed off with a direction to the Principal Secretary, Road Construct Department, Government of Bihar (respondent no. 2) to consider and dispose of the pending appeal of the petitioner within a period of 60 days from the date of receipt/production of a copy of this order, failing which the petitioner will have a liberty to approach this Court in appropriate jurisdiction. Learned counsel for the petitioner is also granted liberty to request the Principal Secretary of the Department to consider his prayer to stay the impugned order of black listing during pendency of the appeal.
