This is an application for bail in connection with Ladania P.S.Case No. 142 of 2016 registered for the offences punishable under Sections 376 of the Indian Penal Code and 4/6 of POCSO Act.

Allegation against the petitioner is that he has committed rape upon a minor girl.

It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case as there is land dispute between the parties for which mother of the petitioner has filed a Misc. Case before the court of CJM (Annexure-2). It has further been submitted that prosecution story as stated in the FIR

Patna High Court Cr.Misc. No.21651 of 2017 (3) dt.10-07-2017 2/2 is not believable at all.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and from perusal of FIR it appears that there is direct allegation against the petitioner of committing rape upon a minor girl and the impugned order further shows that informant in his restatement and the witness have supported the prosecution case and injury report shows injury on her private part, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
