This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

The petitioner was appointed as a Franchisee by North Bihar Power Distribution Company Limited for collecting the amount of electricity bills from the consumers. Allegedly, the petitioner received a sum of Rs. 1,98,333/- but he did not deposit the same in appropriate account, thus constituting an offence under Section 409 of the Indian Penal Code. In course of investigation, it transpired that the petitioner had defalcated a total sum of Rs. 3,69,844/- which he had collected from 340 consumers for the period from March,

Patna High Court Cr.Misc. No.19050 of 2015 (2) dt.25-06-2015 2/2 2014 to May, 2014. It has been stated in paragraphs 10 and 11 of this petition that the petitioner has since deposited the entire amount of Rs. 3,69,850 in the account of North Bihar Distribution Company Limited, Patna.

In view of the aforesaid facts and circumstances, let the petitioner above named, in the event of his arrest/surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Benipatti P.S. Case No. 83 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
