This application is for grant of regular bail in connection with Udwant Nagar P.S.Case nO.399 o 2016 dated 23.11.2016, registered for the offences punishable under Sections 25(1-b)a/26 of the Arms Act Allegation against the petitioner is of recovery of one DBBL gun, 25 cartridges, one Pistol and one 303 Bore cartridge. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case due to election rivalry and now he is in custody for eight months. It is also submitted that due to this, he has also been implicated in one more case just before lodging of this case.

Patna High Court Cr.Misc. No.32032 of 2017 (4) dt.08-08-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the fact that the court below has already ordered that the petitioner may renew his prayer for bail after four months, vide order dated 24.5.2017. As such this application is disposed of with liberty to the petitioner to renew is prayer for bail before the learned court below, who will consider the period of custody of the petitioner and will pass appropriate order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is disposed of.
