The petitioner seeks regular bail in connection with Sakra P.S. Case No. 393 of 2018 for the offences punishable under Sections 414 of the Indian Penal Code.

The allegation is regarding recovery of two pieces of silver Bala as also one gold Mangal Sutra from the suitcase of the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and the fact is that the said articles belong to the petitioner himself. In any view of the matter, the said articles have not been connected with any case of theft, hence, the complicity of the petitioner, at this stage, does not stand proved. It is further submitted that

Patna High Court CR. MISC. No.18119 of 2019(2) dt.02-04-2019 2/2 though the petitioner is accused in one case, but he is on bail in the said case. The petitioner is stated to be languishing in custody since 30.08.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Judge XIII cum A.C.J.M., IV, Muzaffarpur in connection with sakra P.S. Case No. 393 of 2018.
