Petitioner seeks bail in connection Maheshkhut P.S. Case no. 139 of 2019 registered for the offence punishable under sections 379 and 461 of the Indian Penal Code. Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that the petitioner was trying to break lock of closed garage and seeing police started fleeing and was apprehended and disclosed his name, further from this petitioner article used for breaking lock was recovered. Learned counsel submits that petitioner has been falsely implicated in this case and nothing has been recovered from his possession nor it is case of prosecution that any stolen article was recovered from

Learned APP vehemently opposes the prayer for bail. Considering the facts that petitioner is in jail custody since 09.02.2020, charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Ankita Jaiswal, Judicial Magistrate, Ist Class, Khagaria/ concerned court in Maheshkhut P.S. Case no. 139 of 2019.
