JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 364/365/34 of the Indian Penal Code.

On recovery, statement of the victim Digambar Jha was recorded under Section 164 Cr.P.C. wherein he named other persons as his abductor. However, he stated that one Pramila Devio wife of Kaila used to serve food to him during captivity. Submission is that though the petitioner is Pramila Devi but not wife of Kaila. Moreover, she is in custody since 17.01.2018. She has got no criminal antecedent. Investigation of the case is already complete.

No.19627 of 2018 (2) dt.11-04-2018 P2/ Considering the aforesaid fact as well as the fact that the petitioner is a female, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Andharathari P.S. Case No.2 of 2018, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
