====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 354, 376, 504, 506/34 of the Indian Penal Code and later on, Sections 302, 120B, 201/34 were added.

It is alleged that all the F.I.R. named accused persons abused and assaulted the informant and her family members. Learned counsel appearing for the petitioner submits that petitioner is not named in the F.I.R. and has falsely been implicated in this case. Specific accusation of assault is against co-accused, namely, Pappu Rao and name of the petitioner transpired during investigation in the confessional statement of

It is further submitted that similarly situated co-accused, namely, Dhananjay Rao, having similar allegation, has already been granted anticipatory bail by co-ordinate Bench of this Hon'ble Court vide order dated 07.02.2023 passed in Cr. Misc. No. 51601 of 2022. Petitioner has got clean antecedent. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha (Mahila) P. S. Case No. 14 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
