The petitioner is languishing in custody for the offences punishable under Sections 328/302/34 of the Indian Penal Code.
The petitioner is father of the deceased and the informant is wife of the deceased.
According to FIR, the deceased came to his home and he was not feeling easy. Soon thereafter he died. It is further disclosed that the informant is separate from the petitioner since last three years. However, there is property dispute for partition and for that reason the petitioner and others have poisoned the victim to death.
Patna High Court Cr.Misc. No.21893 of 2018 (2) dt.19-04-2018 P2/ Submission of the learned counsel for the petitioner is that this may be a case of commission of suicide due to some difference between the husband and wife. There is no eyewitness of the occurrence.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Amnour P.S. Case No.142 of 2015, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
