2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 353, 504 and 806 of the I.P.C.
3. As per the prosecution case, 19 named accused persons including these petitioners and 30-40 unknown persons kept the dead body on the road and obstructed the road and later became violent against police personnel and started raising slogans against the administration.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this
Patna High Court CR. MISC. No. 19810 of 2024(2) dt.02-04-2024 2/2 case. He further submits that the allegation leveled against the petitioners are general and omnibus in nature. There are no allegation of assault against these petitioners. Petitioners claims clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the aforesaid facts and circumstances and clean antecedent of the petitioners, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Kasma P.S. Case No. 176 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J) sadique/- U T
