The petitioner apprehends his arrest in connection with Complaint Case No. 370 of 2024 initially registered for the offence punishable under Section-498(A) of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act but later on, cognizance has been taken against the petitioner for the offence punishable under Section-498(A) of the Indian Penal Code only.

3. As per complaint, the marriage of the complainant with the petitioner took place eight years ago. It is further alleged that the petitioner started demanding cash of Rs. 1,50,000/- as dowry which was given to the in-laws of the

After sometime, the in-laws including the petitioner started torturing her and consequently, the complainant with her children was ousted from her matrimonial home.

4. Learned counsel for the petitioner has submitted that it is a case of matrimonial dispute. The petitioner is husband of the complainant. The matter was referred to Patna High Court Medication and Conciliation Centre to explore the possibility of restoration of cordial relations between the parties.

5. From perusal of the report of Mediator dated 28-042025, it appears that the dispute has been resolved on mutual consent. According to terms and conditions of the agreement, the petitioner has to pay Rs. 3,00,000/- (three lacs) to opposite party No. 2 through the bank drafts in three equal installments. The first installment shall be paid at the time of furnishing of bail bonds and the second installment of Rs. 1,00,000/ (one lac) shall be paid within a month from the date of payment of the first installment and within the stipulated one months, both parties shall file a case for divorce on mutual consent in the court of learned Family Judge, Rohtas at Sasaram. The third installment of Rs. 1,00,000/- shall be paid after filing of divorce

6. The list of articles given on the occasion of marriage, have been described in the compromise petition and the petitioner agrees to return these articles to the opposite party No. 2.

7. Learned counsel for the petitioner and the informant submit that the matter has been resolved.

Considering the aforesaid facts and circumstances, let the petitioner named above, in the event of arrest/surrender within four weeks before the court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist-cum-Sub Judge-Ist, Sasaram in connection with Complaint Case No. 370 of 2024 subject to the conditions as laid down u/S 438(2) of the Cr.P.C.
