ANJANA MISHRA ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 02.09.2017 in connection with Sahebpur Kamal P.S. Case No.241 of 2017 registered for the offences under Sections 399, 402, 120B of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner was taken into custody only on pure suspicion and the alleged recovery of one country-made pistol and three live cartridges was not made from his conscious possession. He further submits that there is no independent witness to the seizure list.
