JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-05-2019 This application, for grant of anticipatory bail, arises out of Rajgir P.S. Case No. 35 of 2019, disclosing offences under Sections 272, 273, 420, 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act, 2016. Allegation is of recovery of 819 litres of foreign liquor from the house of co-accused Rajendra Bhagat and Ashok Yadav and on their disclosure name of petitioner transpired in this case.
Submission of learned counsel for the petitioner is that save and except the confessional statement of co-accused, there is nothing against the petitioner and further there is no recovery either from the possession of the petitioner or from his house.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned 3rd Additional District & Sessions Judge-cum-Special Judge, Excise, Nalanda, in connection with Rajgir P.S. Case No. 35 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
