ANJANA MISHRA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Aurangabad Town P.S. Case No.82 of 2011 for allegedly having committed the offence under Sections 406, 420, 467, 468 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that the entire allegations as made out in the complaint petition are false and fabricated, only farfetched and misconceived. It is submitted on behalf of the petitioner that a motivated approach was adopted implicating the petitioner in the present case, though there is no specific averment in the complaint petition

Patna High Court Cr.Misc. No.18973 of 2015 (4) dt.18-09-2015 2/2 that any amount had been deposited with the present petitioner. It is further submitted that since the petitioner is the Director of the Company, namely, OCPL, he has been roped in on account of laches of the field staff posted at Aurangabad. Considering the aforementioned facts and circumstances and also that the petitioner has been extended the privilege of anticipatory bail by this Court in other cases of similar nature, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad Town P.S. Case No.82 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
