====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Kahalgaon P.S. Case No. 428 of 2016, registered for the offence punishable under Sections 414 of the I.P.C. and under Sections 25(I-B), 26 and 35 of the Arms Act.

The case of the prosecution is that the petitioner and one other co-accused person were apprehended by the police and a country made pistol along with cartridge was recovered from the possession of the accused persons.

Learned counsel for the petitioner submits that the petitioner has been remanded in three other cases, out of which he is on bail in two cases. It is further submitted that the said cases have been lodged against unknown person and lastly the petitioner

Patna High Court Cr.Misc. No.33697 of 2017 (2) dt.20-07-2017 2/2 is languishing in jail since 15.12.2016 in the present case. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S.
