Petitioner is an accused in a case registered for offence under sections 467, 468, 471, 409 and 420 IPC. The allegation is that one Sanjay Kumar misappropriated Rs. 46,15,481.20.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case as a result of credit of Rs.30,000/- to his account which is alleged to be the part of the misappropriated fund. He has drawn attention of the Court to the order of the BDO, Ladaniya in which said amount of Rs.30,000/- was advanced to the petitioner as he belongs to the
Patna High Court Cr.Misc. No.11781 of 2018 (3) dt.05-04-2018 2/2 BPL family and was beneficiary of Indira Awas Scheme. Prior to the instant case, petitioner has one criminal antecedent in which he is already on bail. Petitioner is in custody since 7.12.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate IV, Madhubani in Ladaniya Police Station Case No. 135 of 2016, GR no. 2251 of 2016 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.
(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
