The petitioners seek bail in anticipation of their arrest in connection with Vaishali Mahila P.S. Case No. 26 of 2019 dated 04.07.2019 instituted for the offences under Sections 341, 323, 504, 506, 498(A), 376 and 511 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Patna High Court CR. MISC. No.14663 of 2020(3) dt.03-08-2021 2/3 The petitioners are the mother-in-law, married sister-in-law and brother-in-laws respectively. It has been alleged in the FIR that the informant was ill-treated by her in-laws. The father-in-law of the informant was having a lustful eye on her.

Learned counsel for the petitioners has submitted that an absolutely false case has been lodged against all the family members of the husband of the informant. Prior to the lodging of this case, the husband of the informant had filed a divorce case vide Divorce Case No. 50 of 2019 and when the notice in that case was served upon the informant, the present case has been filed.

Learned counsel for the petitioners has further submitted that only because the informant could not get along well with her husband, all the petitioners and others members of his family have been made accused in this case.

Regard being had to the aforestated facts, the

No.14663 of 2020(3) dt.03-08-2021 3/3 petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali Mahila P.S. Case No. 26 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
