The petitioner seeks bail in a case registered under Sections 419, 420, 406 and 120(B) of the Indian Penal Code. Allegation is that accused persons were collecting Rs.40/- for application form for the examination for appointment as teacher in Uda-Kishunganj Sub Division and 25 filled up forged application forms and 21 blank application forms were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since3.1.2019 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The allegations made in the F.I.R. is

Patna High Court CR. MISC. No.16857 of 2019(3) dt.16-04-2019 2/2 denied by the petitioner. There is no substantive evidence to suggest his implication in the present case. Other co-accused has been granted bail vide Cr.Misc.No.20925 of 2019. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Uda-Kishunganj, Madhepura in connection with Bihariganj P.S. case No.02 of 2019.
