The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 469, 471, 419 and 120B of the Indian Penal Code. The petitioner is alleged to have gone to the shop of Shambhu Kumar Das for preparing a forge passport of Shakil Ahmad, son of Md. Hadis Ansari of village Kalyanpur, East Champaran. The photograph and voter identity card was not tallying with Shakil Ahmad and he disclosed that he has not applied for any passport.
It is submitted that the police did not collect any further evidence except the disclosure of Shambhu Kumar Das. Shambhu Kumar Das has already been enlarged on bail vide orders passed
Patna High Court Cr.Misc. No.18469 of 2015 (5) dt.16-10-2015 2/2 in Cr. Misc. No. 8455 of 2015.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champran in Kalyanpur P.S. Case No. 311 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
