The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 467, 468, 471, 406, 120(B) of the Indian Penal Code.

Allegation against the petitioner in collusion with other accused persons is said to have taken loan in the names of several poor women after committing cheating with them and preparing forged documents and they had not given amount of loan to them.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that there is no specific allegation against the

Patna High Court CR. MISC. No.24360 of 2021(3) dt.28-10-2021 2/2 petitioner. There is specific allegation against co-accused, namely, Basanti Devi. The petitioner used to run a Tea Stall situated in front of the Nursing Home at Motihari and he is living separately from his father, mother and other family members having no concerned with their family affairs. The petitioner is languishing in judicial custody since 10.10.2020. The petitioner has got no criminal antecedent which is mentioned in para 3 of the bail petition.

Learned APP for the State vehemently opposed the prayer for bail application.

Considering the aforesaid facts and circumstances of the case and that there is no specific overt act against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Motihari Town P.S. Case No. 463/2019 to the satisfaction of learned Court below where the case is pending/ successor Court.
