JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint case No. 1479 of 2015 in which cognizance has taken for the offence punishable under section 406, 420,323, 504 of the Indian Penal Code as well as section 138 of the Negotiable Instrument Act 1881.
According to the prosecution case itself, the amount in question was credited in the account of co-accused Binod Panjiyara and so far as petitioner is concerned, it is alleged that he issued cheque which became bounced. Co-accused Binod Panjiyara has already been granted anticipatory bail by this Court
Patna High Court Cr.Misc. No.18453 of 2015 (5) dt.26-08-2015 2/2 vide order dated 24.12.2014 passed in Cr. Misc. No. 40040 of 2014.
Accordingly, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Complaint Case No.1479 of 2011, subject to condition as laid down under Section 438(2) of the Cr.P.C.
