The petitioner is apprehending his arrest in connection with Mashrakh P.S.Case no.204 of 2008 dated 21.6.2018 , registered for offences punishable under Section 379 of the Indian Penal Code.

Allegation against the petitioner is of theft of the motorcycle and he has been made accused only on the basis of suspicion.

Submission of the learned counsel for the petitioner is that except suspicion there is nothing against him. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above

No.16800 of 2019(3) dt.03-05-2019 2/2 named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-6, Saran, Chapra in connection with Masarakh P.S.Case no.204/2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
