JUSTICE ANIL KUMAR SINHA ORAL ORDER 31-05-2023 Heard Mr. Hans Lal Kumar, learned counsel for the petitioner and Mr. Uday Chand Prasad, learned Additional Public Prosecutor appearing for the State.
Petitioner apprehends his arrest in connection with Tariyani P.S. Case No. 258 of 2021 dated 07.11.2021 registered for the offences punishable under Sections 147, 149, 341, 342, 323, 353, 307, 332, 337, 283, 427, 504, 506 of the Indian Penal Code and Section 3/4 of Damage of Public Property Act. As per the First Information Report, the petitioner along with nineteen named and two hundred unnamed accused persons were protesting regarding accidental death of a person and had blocked the road and when the police party intervened in order to clear the road blockage, the police party was assaulted by the named accused persons including the petitioner
Patna High Court CR. MISC. No.17915 of 2023(2) dt.31-05-2023 2/3 and other unknown persons and in the scuffle one Sub-Inspector namely, Jitendra Kumar sustained injury.
Learned counsel for the petitioner submits that altogether nineteen named accused persons along with two hundred persons have been made accused in the present case and allegation against them is general and omnibus in nature. He further submits that other co-accused persons have been granted anticipatory bail by different co-ordinate Benches of this Court vide orders passed in Cr. Misc. Nos. 17329 of 2022 and 63671 of 2022.
Regards being had to the submission made by the parties and taking into consideration the generality of the allegation made against the petitioner and others, similarly situated co-accused persons have been granted bail by coordinate Benches of this Court, I am inclined to grant anticipatory bail to the petitioner.
This application is accordingly allowed.
Accordingly, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner, above named, shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned
