JUSTICE SATYAVRAT VERMA ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 323, 498(A), 379, 504 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and being husband has been falsely implicated in the present case. Petitioner fairly submits that the mediation proceedings fail, but then petitioner is willing to maintain the informant by giving maintenance of Rs.5,000/- per month, which shall commence from 18th of July, 2023.

No.14795 of 2020(6) dt.06-07-2023 2/3 The learned counsel for the informant does not dispute the submission made by the learned counsel for the petitioner and submits that he will whatsapp the bank account number of the informant on the whatsapp number of the learned counsel for the petitioner and the learned counsel for the petitioner submits that he will forward the same to the petitioner, so that the maintenance commences as agreed from 18th July, 2023.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of Mr. Avinash Kumar, the learned J.M. 2nd Class, Madhubani in connection with Complain Case No.428 of 2018, CIS No.408 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.

However, in the event, if the petitioner, for two consecutive months, does not pay the amount as agreed, the informant will be at liberty to file an application seeking
