The petitioner, who is in custody, seeks bail in connection with Bairganiya P.S. Case No. 200 of 2017 registered for the offence punishable under Sections 366, 372, 373, 34, 120(B) of the Indian Penal Code.
Informant is the mother of victim, who, in her written complaint has stated that her married daughter had gone outside the house on 15.07.2017 at about 5:00 AM to attend the call of nature then petitioner and three others came and kidnapped her and took her away on a Tempo. Learned counsel for the petitioner submitted that written complaint has been made on 02.08.2017 whereas the
Patna High Court Cr.Misc. No.5534 of 2018(4) dt.28-02-2018 2/2 occurrence took place on 15.07.2017 and there is unexplained delay of 17 days in lodging the FIR. It has been further submitted that petitioner is co-villager and he has been made accused on the basis of suspicion only and there is no incriminating material against him to connect him for the said crime. It has further been submitted that petitioner has a clean antecedent and he is in custody since 03.08.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Bairganiya P.S. Case No. 200 of 2017.
