BADAR ORAL ORDER 16-02-2022 Perused the explanation tendered by the learned Additional Sessions Judge-XIX, Muzaffarpur. It is reported that as the record was received belatedly, the trial could not be concluded within a period of six months. He further reported that five witnesses are already examined and summons have been issued against rest of the witnesses.

In this view of the matter, the learned trial court is directed to keep the trial for day-to-day hearing in the light of mandate of Section 309 of the Cr.P.C. The trial is part heard. The trial be concluded at any cost within a period of five months from today. The report in that regard be forwarded to this Court after conclusion of the trial.

In the light of this direction, I am not inclined to consider this second application for bail for the offence
