Petitioners are apprehending their arrest in a case registered for the offences punishable under Section 3 R.P. (U.P.) Act, 1966 and 174 of the Railway Act.

Accusation is of committing theft of coal from the railway wagon parked in the railway yard. Recovery was made from co-accused Bhuna Yadav, who has named the petitioners.

It is submitted by the learned counsel for the petitioners that there is no recovery from the possession of the petitioner and only on confession of the apprehended coaccused the petitioners have been roped in the present case. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.9455 of 2015 (2) dt.20-04-2015 consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Kodarma R.P.F. P.S. Case No. 16 of 2014, pending in the court of learned Railway Judicial Magistrate, Gaya.

With this observation this application is disposed of.
