JUSTICE ARUN KUMAR ORAL ORDER 15-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bhar PS Case No. 392 of 2017 registered under Sections 399, 402, 414 of the IPC and Sections 25(1-B)A, 26 and 35 of the Arms Act. Submission is that the petitioner is said to have been apprehended and one loaded country made pistol was recovered from his possession however he is in custody since 28.7.2017. Learned Counsel for the State submits that the petitioner has criminal antecedents.

Having considered the said facts and circumstances, the petitioner, namely, Md. Rais is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Nalanda at Biharsharif in connection with Bihar PS Case No. 392 of 2017 with the condition that one of the bailors must be a close family member of the petitioner.

The petitioner is directed to appear before the trial court on each appointed day before the trial court and in case of failure to appear on two consecutive dates except because of reasonable cause, his bail bonds shall be liable to be cancelled. If the petitioner is further found involved in any other case in future then in such situation also his bail bonds shall be liable to be cancelled.
