2. The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 30(a) and 36 of the Bihar Prohibition and Excise (Amendment) Act.

3. It appears from the records of the case that the earlier prayer for anticipatory bail of the petitioner has already been rejected vide order dated 14.10.2022 in Cr. Misc. No. 41718 of 2022 which is annexed as Annexure-1 to this application. The prayer is being made on behalf of the petitioner for grant of anticipatory bail for the second time. There is no new fact to necessitate the grant of anticipatory bail at a subsequent stage.

4. In such view of the matter, the prayer for anticipatory bail of the petitioner is again rejected in connection

Patna High Court CR. MISC. No.26474 of 2024(4) dt.16-04-2025 2/2 with Malsalami P.S. Case No. 181 of 2022.

5. However, if the petitioner surrenders before the learned court below and prays for regular bail, the same may be considered by the learned court below on its own merit without being prejudiced by this order considering the fact that the petitioner is an old lady aged about 65 years.
