Heard the parties.

The petitioner apprehends his arrest in connection with Turkauliya (Banjariya) P.S. Case No.765 of 2021 registered for the offence under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Petitioner has criminal antecedent of similar nature and his name has transpired in the confessional statement of coaccused Munna Kumar, who is the driver of Tempo from which recovery of illicit liquor was made.

No.14792 of 2022(2) dt.08-04-2022 2/2 In view of the allegations levelled against the petitioner, this anticipatory bail application is not maintainable in view of the judgment of the Full Bench of this Court in the case of Ram Binay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)]. Accordingly, it is dismissed as not maintainable.
