The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 465, 467, 468, 469, 471, 120B of the Indian Penal Code.
Accusation is of transfer of the land of the informant on the basis of forged documents on 23.03.2010 by petitioner no. 2 Anil Singh in favour of petitioner no. 1 Dig Vijay Pratap, whereas petitioner no. 3 is deed writer.
It is submitted by the learned counsel for the petitioners that admittedly the victim husband died about 35
Patna High Court Cr.Misc. No.9470 of 2015 (2) dt.20-04-2015 years of prior to the lodging of the case and the husband of the informant in 1979 transferred the land by registered sale deed to Jitendra Yadav. Jitendra Yadav executed power of Attorney with regard to land in question in favour of Anil singh. Though, Title Suit is also pending with regard to the land in question. Considering the nature of accusation, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 364 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
