====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 12-02-2018 Heard Sri Ramesh Kumar Singh, learned counsel for the petitioner and Sri Ashok Kumar, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Complaint Case No.3970 C of 2013 registered for the offence under Sections 323/420/504 of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. Learned counsel for the petitioner, by way of referring to the complaint petition, submits that in a case of civil dispute, colour of criminal offence has been given.

Besides hearing learned counsel for the parties, I have also perused the material available on record and after going through

Patna High Court Cr.Misc. No.6661 of 2018(2) dt.12-02-2018 2/2 the same, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, let the petitioner, namely, Gagan Kumar Mehta, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Complaint Case No.3970 C of 2013, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
