The petitioner is in judicial custody in connection with Mahila P.S. Case No. 12 of 2021 for the offences under Sections 376, 420, 323, 341, 504 and 506/34 of the Indian Penal Code and Section 4/6 of the POCSO Act.

The allegation in the FIR is that the petitioner made physical relationship with the minor girl repeatedly, a fact fully supported in the statement made by the victim girl under Section 164 of the Code of Criminal Procedure.

Taking in account the aforesaid facts that the allegation of making physical relationship with the minor girl is attributed to the petitioner herein, this Court is not inclined to grant any relief to him and the application is hereby rejected.
