The petitioner seeks bail in a case registered under Section 302 of the Indian Penal Code.

The prosecution case in brief is that informant's husband had gone to market for selling vegetables and on returning he had gone to the hut of the petitioner who used to sell wine illegally. Due to differences for money, there was some hot talk between the deceased and the accused and in consequence thereof, the accused killed the deceased by knife blows and thrown the dead body of the deceased which was found later on. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.13827 of 2019(4) dt.19-07-2019 2/2 petitioner is in custody since 16-01-2019. Charge sheet has already been submitted. The name of the petitioner has come in this case only on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest the participation of the petitioner in the alleged offence.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Saran at Chapra in connection with Bheldi P.S.
