Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and 7 of the Essential Commodities Act. It is alleged that the petitioner being the Headmaster of the school sold rice of mid day meal to coaccused Md. Nirale and from whose house 18 bags rice of 50 K.gs each have been recovered.
It is submitted by the learned counsel for the petitioner that petitioner did not receive any supply of mid day meal rice in the month of December, 2013 and January, 2014. Considering the above fact, let the above named petitioner be released on provisional anticipatory bail for four months in the event of his arrest or surrender before the
Patna High Court Cr.Misc. No.9484 of 2015 (2) dt.20-04-2015 learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Moro P.S. Case No. 02 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
In the meantime, the learned court below will get it verified that the petitioner actually did not receive any rice in the month of December, 2013 and January, 2014 if it is found true the provisional anticipatory bail of petitioner will be confirmed by learned court below, otherwise the petitioner will surrender and pray for regular bail.
