The petitioner seeks bail in Yadopur P.S. Case No. 76 of 2017 registered under Sections 272, 273 and 420 of the Indian Penal Code and Sections 30(a)(b)(c) of the Bihar Prohibition and Excise Act, 2016.
55 litres of country made liquor is said to have been recovered from the gunny bag and co-accused Harun Mahto was apprehended while three accused persons managed to escape taking benefit of murk. The said Harun Mahto disclosed the name of the petitioner as one of his accomplice involved in the occurrence.
It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.22015 of 2018 (2) dt.17-04-2018 2/2 that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized liquor. He was not apprehended on the spot. He has been falsely implicated in the case by co-accused Harun Mahto. He has no criminal antecedent. He has been languishing in custody since 14.03.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-II, Gopalganj in connection with Yadopur P.S. Case No. 76 of 2017.
