The petitioner seeks regular bail in connection with Maranchi (Panchmahla O.P.) P.S. Case No. 31 of 2021 registered for the offence under Sections 341, 323, 326, 307 of the IPC and Section 27 of the Arms Act.

Prosecution story in nutshell is that while the informant with his brother were in a boat for the purpose of fishing in the meantime a bullet hit his brother on the right side of his waist thereafter this case has been registered against unknown.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

The petitioner not named in the FIR and he earlier remanded in other criminal cases due to which his name has been sprang up in this present case. It is further submitted vide para 13 of the petition that during entire investigation, no witness has stated that he either saw the petitioner at the place of alleged occurrence or involved in this crime. Petitioner is languishing in judicial custody since 6.12.2021.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Maranchi (Panchmahla) P.S. Case No. 31 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Barh.
