The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Excise Act, 2016. The learned counsel for the petitioner submits that the petitioner is in custody since 21.01.2022, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of recovery of 1170 litre of liquor from a Bolero car.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot rather his name was disclosed by the villagers with whom he was on an inimical term.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, was not arrested from the spot and his name came in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajepur P. S. Case No.57 of 2021.

The application stands allowed.
