Petitioner's claim for grant of 3rd progression under the Modified Assured Career Progression (for brevity
Patna High Court CWJC No.4163 of 2023 dt.01-09-2023 2/3 'M.A.C.P.') Scheme has been considered by the Additional Chief Medical Officer-cum-District Program Officer (Leprosy), Nalanda (respondent No. 7), who has recommended grant of the same vide letter dated 23-03-2021, bearing Memo No. 86 (Annexure- 4).

As per counter affidavit this recommendation is pending before screening committee at the Health Directorate, Bihar, Patna. Such stand, as per the counter affidavit filed on behalf of the respondent Nos. 5- 7, depicts a very undesirable state of affairs. Pendency of consideration of petitioner's claim for benefits of financial progression, by now has remained illusive in the last 2 years, in spite of recommendation of respondent No. 7.

The Court, therefore, is directing the Director-inChief, (Disease Control, Public Health Para Medical), Health Services, Government of Bihar, Patna (respondent No. 3) to ensure that a final decision is taken, based on recommendation dated 23-03-2023, referred above, within four weeks from the date of receipt/production of a copy of this order. 5.
The amounts found due and admissible, as a result of such consideration are also required to be paid to the petitioner within four weeks, thereafter.
