2. The petitioner has preferred this application for grant of regular bail in connection with Jehanabad (Town) P.S. Case No. 170 of 2024 dated 27.02.2024 registered for the offence punishable under Section 394 of the I.P.C.
3. As per the prosecution case, on 27.02.2024 at 3.45 A.M., the informant alongwith his four friends was going to Manglahat for purchasing animals by his Pick-up Van bearing Registration No. BR-01GM-9426. When they reached flyover bypass which is ahead of Jehanabad Rajabazar then four persons riding on two motorcycles surrounded him. It is further alleged that they were having pistols in their hand and on the

All the accused persons had covered their faces. Thereafter, the informant protested, upon which, a miscreant assaulted the informant with butt of the gun causing head injury. It is further alleged that they also took Rs. 7,00,000/- in cash from the Pickup Van. They also assaulted them and took mobile bearing No. 8084178183 of the informant and key of the Pick-up Van.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Ranjeet Kumar. The other co-accused person has already been granted bail by this court vide order dated 13.05.2024 passed in Cr. Misc. No. 34211/2024. The petitioner has 14 antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 05.08.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.15855 of 2025(2) dt.15-05-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jehanabad in connection with Jehanabad (Town) P.S. Case No. 170 of 2024, with the conditions;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled. (ii). If the petitioner is found involved in similar nature of offence in the future, the prosecution will be at liberty to move for cancellation of his bail bonds.
