Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the I.P.C.

It is alleged that this petitioner took the grandson of the informant Rahul Kumar and subsequently Rahul Kumar came home with burnt injury. Rahul Kumar disclosed that this petitioner set him on fire after pouring kerosene oil.

It is submitted by learned counsel for the petitioner that there is a variation with regard to going of the victim in the company of the petitioner between the accusation levelled in the First Information Report and the statement of the victim.

The accusation against the petitioner is

Patna High Court Cr.Misc. No.9523 of 2015 (2) dt.20-04-2015 2/2 specific not only in the First Information Report but also in the statement of the victim who subsequently succumbed to the injuries.

Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner. Accordingly the application is dismissed in connection with Shivsagar P.S. Case No. 109 of 2014, pending in the Court of learned Chief Judicial Magistrate, Rohtas. (Dinesh Kumar Singh, J) Shageer/- U T
