JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-04-2016 Petitioner is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 307 and 498A I.P.C against Md. Saleem, under Sections 323, 354 I.P.C against Md. Rahber @ Kariya and Md. Mukhtar and under Section 120B against the petitioner and others.

The prosecution case is that co-accused Md.

Salim performed second marriage with the minor daughter of the petitioner namely Salma.

It is submitted by learned counsel for the petitioner that thrust of accusation is against the husband of the complainant. It is further submitted that learned Sessions Judge has committed error in recording that petitioner is the

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Supaul in connection with Complaint Case No. 1296C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
