Petitioner is languishing in judicial custody since 14.06.2017 in connection with Sikandra P.S. Case No. 71 of 2017 for offences punishable under Sections 273, 414 of the Indian Penal Code and Sections 30/30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel, is that on secret information that some persons are carrying heavy consignment of illicit wine the police villagers intercepted a Indigo car and from the dickey 200 liters country made wine was recovered in which two persons were caught who were alleged to be owner and petitioner along with two others were in another Bolero car.

Patna High Court Cr.Misc. No.36600 of 2017 (4) dt.24-08-2017 It has been submitted by the learned counsel for the petitioner that he is innocent, nothing has been recovered from his car in which he boarded and he has clean antecedent. He submits that two of the accused persons were granted privilege of bail in Cr. Misc. No. 33938 of 2017 on 20.07.2017 and Cr. Misc. No. 35234 of 2017 on 10.08.2017.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Sikandra P.S. Case No. 71 of 2017.
