Patna High Court Cr.Misc. No.40077 of 2013 (5) dt.05-07-2016 2/2 In the present petition the petitioners have prayed for quashing of an order dated 30.4.2013 passed by the learned Sub Divisional Judicial Magistrate, Betiah, West Champaran in S.C. No. 449 of 2012 arising out of Complaint Case No. 3103(C ) of 2008. By the said order prayer for discharge of the petitioners was rejected.

In this case earlier a report was called for from the court below regarding the stage of the case which has been received and kept at flag -A. The report dated 24th May 2016 makes it clear that one of the petitioners i.e. petitioner no. 10 has jumped bail and process under section 82 & 83 Cr.P.C. has already been issued and due to the said reason the case is still at the stage of appearance. Besides this I have also perused the materials available on record including the impugned order. I do not find any ground for interference with the impugned order. The petition stands dismissed.
