JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-03-2016 Heard learned counsels for the petitioners and the State. The petitioners being the married sister and brother-inlaw (Bahnoi) of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 328 and 304B of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after two years of the marriage for non-fulfillment of the dowry demand by administering poison.

It is submitted by learned counsel for the petitioners that the victim was provided medical assistance and only on suspicion, the accusation has been levelled against the petitioners. Petitioners got married much prior to the marriage of the victim and they used to reside separately from the husband of the victim. The accusation against the petitioners is omnibus and general.

No.12458 of 2016 (2) dt.16-03-2016 2/2 Considering the thrust of accusation against the husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Vaishali at Hajipur in connection with Goraul (Kathara O.P.) P.S. Case No. 279 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
