JUSTICE SANJAY PRIYA ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Warisaliganj P.S. Case No. 14 of 2017 instituted for the offence under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code, Section 10 of the Bihar Conduct of Examination Act and Section 66 of the I.T. Act. It has been submitted on behalf of the petitioner that informant got secret information that Gauri Sharma has taken house of one Satya Narayan Sharma on rent in which some persons have assembled for committing forgery in the examination of Staff Selection Commission with Mobile phones, blue-tooth etc. after receiving huge amount.

The raiding party was constituted and the petitioner along with several persons as named in the written report is said to have been apprehended.

No.26408 of 2017 (3) dt.10-07-2017 2/2 From the seizure list itself it appears that no incriminating articles with regard to the commission of illegal activity in the examination have been recovered from the possession of the petitioner. It is mentioned in the written report that one Mobile phone, Aadhar Card and 150/- rupees cash has been recovered from his possession.

It has been submitted on behalf of the petitioner that other co-accused persons with similar allegations have already been granted bail by this Court vide order dated 30.6.2017 passed in Cr. Misc. 24877 of 2017, 22824 of 2017 and 2410 of 2017 respectively. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Nawada, in connection with Warisaliganj P.S. Case No. 14 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
