This is an application for bail in connection with Sessions Trial No. 118 of 2006, arising out of Baliya P.S.Case No. 108 of 2003 registered for the offences punishable under Sections 302, 341 and 144 of the Indian Penal Code.

This is a case of misuse of privilege of bail and when the case was at the evidence stage he left making pairvi. It has been submitted on behalf of the petitioner that petitioner has remained in custody for eight months and he is ready to abide by any condition that may be imposed by this Court, if bail is granted to him.

Heard learned APP also.

In this case a report has been called for from the court below and the report shows that seven witnesses have been examined and trial is likely to be concluded within three months. Having heard both sides and considering the aforesaid

Patna High Court Cr.Misc. No.32812 of 2017 (3) dt.04-08-2017 2/2 facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Sinha, Additional Sessions Judge-VII, Begusarai, in connection with Sessions Trial No. 118 of 2006, arising out of Baliya P.S.Case No. 108 of 2003, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a family member of petitioner having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and appeal on each and every date in court, except with permission of the court, failing which his bail bond shall be cancelled by the court below.
